Happy as Larry: Why Oracle won the Google Java Android case

SilverWave

Worth it to own the non Apple smart phone market.

Even if the Supreme Court doesn’t mess this up for Larry, even if that 8B isn’t reduced, it’s still worth the price for Google.

Think how much Microsoft would have paid to be in the position in mobile that Google is in today.

Google is master of its own destiny, if that ends up costing 8B well so be it.

Apple must apologise for its surly apology on its website on Saturday

Re: Inaccurate might be pushing it a little... nope: both untrue” and “incorrect."

Apple Inc. (AAPL) was criticized by U.K. judges in a patent lawsuit with Samsung Electronics Co. (005930) for posting a notice on its website that was “untrue” and “incorrect.”

The Court was particularly unimpressed with the fact that, in its view, the paragraphs which had been added were clearly wrong. In particular it will be noted that, in the final paragraph, Apple had said “in a case tried in Germany regarding the same patent, the court found that Samsung engaged in unfair competition by copying the iPad design” [Emphasis added]. The Court took exception to the use of the words “the same patent” since the British action did not involve any patent, being solely concerned with registered design. Similarly, the Court did not like the statement that the Judge Birss had "made several important points comparing the designs of the Apple and Samsung product" [Emphasis added]. As the Court pointed out, Judge Birss made no findings in relation to the Apple PRODUCT – his findings were in relation to the Apple REGISTERED DESIGN.

Installing Xubuntu Desktop is like having installed Xubuntu originally.

It will install the desktop and all the applications that make up Xubuntu.

It does not remove any applications that are part of Ubuntu.

This is great - The ease of use - The clean feel - The speed!

Panels that work.

Application menus.

Notifications that can be closed.

Panel launchers.

Decent virtual desktop switcher (in the panel) with thumbnails.

Widows Buttons to show what’s open but minimised.

Easy theme config of a text file the change pop up colours.

Nice application finder (can drag and drop to create launchers).

Nice sane file manager.

Reg Quote: "You're not allowed to buy a company (at least, under US rules you're not) solely to get your hands on their tax losses. But Google is buying the pile of patents, isn't it? I mean, look, they took part in the Nortel patent auction, everyone knows they're trying to buy patents.

You would really have to be very cynical indeed to think that Google didn't take the Nortel auction seriously. Did I mention that because Nortel was in Chapter 7 liquidation (or the Canadian equivalent) there were no tax losses that could be transferred? I didn't?"

Re: the jury seems unswayed. Ah... NO see 4a

question 4 was this:

A. Has Google proven that Sun and/or Oracle engaged in conduct Sun and/or Oracle knew or should have known would reasonably lead Google to believe that it would not need a license to use the structure, sequence, and organization of the copyrighted compilable code?

And the jury said Yes.

Re: Nine lines of code? Hypocrisy alert.

Quote: 1. Those are the "9 lines of code" I mentioned earlier.

Not all of the Java libraries were written by Sun or Oracle. There are a lot of 3rd party contributions. timsort was a 3rd party contribution. One of timsort's developers copied an internal Java function as an interim solution until he could link to that function directly. This function is a simple array bound check function a 1st year CS student could write call rangeCheck.

That 3rd party contributor was Google. When it came to implementing timsort for the Android, Google took their contribution and accidentally failed to replace rangeCheck. A minor mistake (Copyright violation) of no consequence (outside of this trial).

Not really:

"Judge Alsup tells them they don't have to reach agreement on question 4. That's just advice for him, because he has to decide that in the end. No, they tell him they are at an impasse on one of the first three questions on the form."

1. As to the compilable code for the 37 Java API packages in question taken as a group:

A. Has Oracle proven that Google has infringed the overall structure, sequence and organization of copyrighted works?

2. As to the documentation for the 37 Java API packages in question taken as a group:

A. Has Oracle proven that Google has infringed?

3. Has Oracle proven that Google’s conceded use of the following was infringing, the only issue being whether such use was de minimis:

Well if they want they could fork Firefox and CorpFox could stay on the 4.0 code for years.

Or they could pay someone to back port security changes to 4.0 for them.

How many Firefox developers do Corps pay for?

I have a feeling it is a small number, possibly none.

So if this is important to IBM they can pay for it just like they do for other things.
